AgilOne is a provider of predictive customer intelligence solutions. Our Services include a data storage and computational platform, reporting and business intelligence portal, predictive engine, and integrated list execution solution. Some of our products are offered as application Services, meaning that we host a software application that our clients access via the worldwide web. Each client understands that in the course of providing our Services to it, we collect or receive information about the individual to whom our client directs its marketing messages. Some of the information that we collect and store on our client’s behalf is Personally Identifiable Information. AgilOne may in the course of providing its Services collect data from the internet using web beacon or Stat One. AgilOne may also purchase third party data on the behalf of its client for use by such client.
As between AgilOne and our client, all of the information we receive from our client belongs to our client and not to us. We may use such information only as provided in our written agreement with the individual client. While our specific responsibilities regarding such information are found in these written agreements, we do not allow individual information collected and stored for one client to be accessed or used by any other AgilOne client (or by AgilOne on our own behalf). We reserve a limited right to use our client’s information to compile aggregated statistics, which we use to report such facts as how many emails we have delivered. However, we do not disclose this information in such a way as to enable anyone to identify a client or any individual. Our client agreements also permit us to disclose any information if required by law or court order.

AgilOne respects and protects the individual privacy and confidence of our clients, stakeholders, employees, business partners, and others who may use our Services. Protecting consumer privacy is important to AgilOne. AgilOne complies with the U.S.-EU Safe Harbor Framework and the U.S.-Swiss Safe Harbor Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries and Switzerland. AgilOne takes reasonable steps to protect all data in our possession from loss, misuse and unauthorized access, disclosure, alteration, and destruction. For example, the confidentiality of information being transferred on portable media (e.g. laptop, flash drive) or across networks is protected by our use of appropriate encryption techniques.
AgilOne controls and physically protects media and establishes appropriate operating procedures to protect documents, computer media, input/output data and, system documentation from unauthorized disclosure, modification, removal, and destruction.
Prior to disposal, AgilOne checks all items of equipment containing storage media to remove or securely overwrite data and licensed software. Devices containing sensitive information are physically destroyed or the information is destroyed, deleted or overwritten.
We have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the data from loss, misuse, unauthorized access or disclosure, alteration or destruction. However, we cannot guarantee the security of data in our possession or data that is on, or transmitted via, the Internet.
With whom we may share your information We will share your information with third parties only in the ways that are described in this Policy. The information we collect is not shared, rented, or sold to any third-parties. We may provide your information to companies that provide services to help us with our business activities such as responding to your inquiries or offering customer service. As we continue to develop our business, we may sell certain or all of our assets.
